II.1. If you are a visitor to the Website, KOSZ SYSTEMS S.R.L. will process your personal data that you provide:

III.1. If you are a visitor to the Website, KOSZ SYSTEMS S.R.L. , processes your personal data as follows:

If you are a customer, we will process your data for the entire duration of the contractual relationship and subsequently in accordance with the legal obligations incumbent on KOSZ SYSTEMS S.R.L. (e.g., in the case of financial-accounting supporting documents for which the retention period provided by law is 10 years from the date of the end of the financial year during which they were prepared).

• the right to information, respectively the right to receive details regarding the processing activities carried out by KOSZ SYSTEMS S.R.L., as described herein;

• the right of access to the data, respectively the right to obtain confirmation from KOSZ SYSTEMS S.R.L.  regarding the processing of personal data, as well as details regarding the processing activities such as the way in which the data is processed, the purpose for which the processing is carried out, the recipients or categories of recipients of the data, etc.;

• the right to rectification, respectively the right to obtain correction, without justified delay, by KOSZ SYSTEMS S.R.L. inaccurate/unjustified personal data, as well as filling in incomplete data; The rectification/completion will be communicated to each recipient to whom the data have been transmitted, unless this proves impossible or involves disproportionate efforts.

• the right to erasure of the data, without undue delay, (“the right to be forgotten”), if one of the following grounds applies:

  1. they are no longer necessary for the fulfilment of the purposes for which they were collected or processed;
  2. where consent is withdrawn and there is no other legal basis for the processing;
  3. where the data subject objects to the processing and there are no overriding legitimate grounds;
  4. where personal data have been unlawfully processed;
  5. where personal data must be erased in order to comply with a legal obligation;
  6. the personal data have been collected in connection with the provision of information society services under Union or national law to which the controller is subject.

It is possible that, following the request for deletion of data, KOSZ SYSTEMS S.R.L. to anonymise this data (thus depriving them of their personal character) and to continue the processing for statistical purposes under these conditions;

• the right to restriction of processing to the extent that:

  1. the person disputes the accuracy of the data, for a period that allows us to verify the accuracy of the data;
  2. the processing is unlawful and the data subject objects to the erasure of the personal data, requesting instead the restriction of their use;
  3. the controller no longer needs the personal data for the purpose of processing, but the data subject requests them for the establishment, exercise or defence of legal claims;
  4. or the data subject has objected to the processing (other than direct marketing), for the period of time in which it is verified whether the legitimate rights of the controller prevail over those of the data subject.

• the right to data portability, i.e. (i) the right to receive personal data in a structured, commonly used and easy-to-read format, and (ii) the right to have such data transmitted by KOSZ SYSTEMS S.R.L. to another data controller, provided that the conditions laid down by law are met;

• the right to object – with regard to processing activities, it can be exercised by submitting a request as indicated below;

• at any time, for reasons related to the particular situation in which the data subject finds himself, that the data concerning him or her be processed on the basis of the legitimate interest of KOSZ SYSTEMS S.R.L. or on the basis of the public interest, except in cases where KOSZ SYSTEMS S.R.L. it can demonstrate that it has legitimate and compelling grounds justifying the processing and that override the interests, rights and freedoms of the data subjects, or that the purpose is to establish, exercise or defend legal claims;

• the right to address the National Supervisory Authority for Personal Data Processing or the competent courts, to the extent that you deem it necessary.
